1. Acceptance of Terms

By creating an account, downloading our mobile application, or using any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and DriveFixIt Pvt Ltd.

If you are using our Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Service Description

Drive Fixit operates as a technology platform that connects customers with qualified service providers for:

• Emergency roadside assistance (towing, battery jumpstart, flat tire repair)
• Key lockout services
• Doorstep car servicing and maintenance
• Vehicle diagnostics
• EV rapid response services
• Fleet management solutions

Drive Fixit acts as an intermediary and does not directly provide the services. Service providers are independent contractors and are not employees or agents of Drive Fixit.

3. User Eligibility

To use our Services, you must:

• Be at least 18 years of age or the age of legal majority in your jurisdiction
• Have the legal capacity to enter into binding contracts
• Provide accurate and complete registration information
• Maintain a valid payment method on file
• Comply with all applicable laws and regulations
• Not be barred from using our Services under Indian law or other applicable laws

4. Account Registration and Security

4.1 Account Creation

To use certain features, you must create an account by providing:

• Valid mobile number for OTP-based authentication
• Email address (optional for notifications)
• Full name as per government-issued ID
• Vehicle information (make, model, registration number)
• Payment information for service transactions

We use phone number-based authentication with OTP (One-Time Password) verification for secure, password-free access to your account.

4.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your mobile phone and OTP codes
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach
• Ensuring your account information is accurate and up-to-date

4.3 Account Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or illegal activities
• Abuse or harass service providers or staff
• Provide false or misleading information
• Fail to pay for services rendered

5. Service Requests and Fulfillment

5.1 Service Requests

When requesting a service:

• Provide accurate location and vehicle information
• Describe your issue clearly and honestly
• Ensure your vehicle is accessible and safe to service
• Be available to communicate with the service provider
• Follow all safety instructions provided

5.2 Service Availability

Service availability depends on:

• Geographic location and coverage area
• Time of day and demand
• Weather conditions and road accessibility
• Service provider availability
• Nature and complexity of the service required

We strive to fulfill all service requests but cannot guarantee service availability in all circumstances.

5.3 Cancellations

• By Customer: You may cancel a service request before the service provider arrives. Cancellation fees may apply if cancelled after a service provider has been dispatched.
• By Service Provider: Service providers may cancel if the location is unsafe, information provided is inaccurate, or the service cannot be completed as described.
• By Drive Fixit: We reserve the right to cancel any service request for safety, security, or operational reasons.

6. Pricing and Payment

6.1 Pricing

• Prices are displayed in Indian Rupees (INR) and include applicable taxes unless stated otherwise
• Prices may vary based on location, time of day, service type, and demand (surge pricing)
• You will be shown an estimated price before confirming your service request
• Final charges may differ if additional services are required or if initial information was inaccurate
• We reserve the right to change prices at any time

6.2 Payment Methods

We accept:

• Credit and debit cards (Visa, Mastercard, RuPay, American Express)
• UPI (Google Pay, PhonePe, Paytm, etc.)
• Digital wallets
• Net banking
• Cash (for select services)

6.3 Payment Authorization

By providing payment information, you:

• Authorize us to charge the applicable fees
• Confirm that you are authorized to use the payment method
• Agree to pay all charges incurred under your account
• Agree to pay any additional charges for services beyond the initial estimate

6.4 Refunds

Refunds are provided at our discretion and may be issued if:

• Service was not provided as described
• You were charged incorrectly
• Service provider failed to arrive after confirmation
• Other exceptional circumstances warrant a refund

Refund requests must be submitted within 7 days of service completion. Refunds are typically processed within 7-10 business days.

7. User Conduct and Responsibilities

You agree not to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Harass, threaten, or abuse service providers or staff
• Provide false, misleading, or fraudulent information
• Attempt to manipulate or game the platform
• Use the Services for any illegal purpose
• Reverse engineer, decompile, or hack the platform
• Share your phone number or OTP codes with others
• Use automated systems (bots) to access the Services
• Interfere with the proper functioning of the platform

8. Intellectual Property Rights

All content, features, and functionality of our Services, including but not limited to:

• Text, graphics, logos, icons, images
• Software, code, and algorithms
• Trademarks, service marks, and trade names
• Design, layout, and look-and-feel

are owned by DriveFixIt Pvt Ltd or our licensors and are protected by Indian and international intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

9. Disclaimers and Limitations of Liability

9.1 Service Disclaimer

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT:

• Services will be uninterrupted, secure, or error-free
• Results obtained from using the Services will be accurate or reliable
• Service providers will meet your expectations
• Any defects or errors will be corrected

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRIVE FIXIT SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Loss or damage to vehicles or property
• Personal injury or death resulting from service provision
• Actions or omissions of service providers
• Third-party products, services, or websites

Our total liability shall not exceed the amount you paid for the specific service that gave rise to the claim or ₹5,000, whichever is less.

9.3 Third-Party Service Providers

Service providers are independent contractors. We do not control, employ, or supervise service providers. We are not responsible for their acts, omissions, negligence, or misconduct. Any claims arising from services provided should be directed to the service provider.

10. Indemnification

You agree to indemnify, defend, and hold harmless DriveFixIt Pvt Ltd, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any rights of another party
• Your conduct in connection with the Services
• Any false or misleading information you provide

11. Dispute Resolution

11.1 Informal Resolution

Before initiating formal legal proceedings, you agree to first contact us at legal@drivefixit.in to seek an informal resolution. We will make reasonable efforts to resolve disputes within 30 days.

11.2 Arbitration

If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in English in New Delhi, India.

11.3 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law provisions. The courts in New Delhi shall have exclusive jurisdiction over any disputes.

12. Insurance and Safety

While we require service providers to maintain appropriate insurance coverage, you should ensure:

• Your vehicle insurance is current and adequate
• You understand the scope of coverage for services provided
• You follow all safety instructions provided by service providers
• You report any safety concerns immediately

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting updated Terms on our website and app
• Sending email notification to registered users
• Displaying an in-app notification

Your continued use of the Services after changes take effect constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Services.

14. Termination

Either party may terminate this agreement:

• By You: You may close your account at any time through the app settings or by contacting customer support
• By Us: We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or pose a safety risk

Upon termination, you remain liable for all charges incurred before termination. Provisions that by their nature should survive termination shall survive, including intellectual property rights, disclaimers, limitations of liability, and dispute resolution.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Drive Fixit regarding the Services.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.

15.5 Force Majeure

We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, acts of God, war, terrorism, strikes, or government actions.
